What has to be in process when it takes effect in July? If a Form 3 is in the works are you GTG or does the Form 4 have to be in?

I could be wrong, but the way I read it, which was awhile back, was if your Form 4 was post marked July 12, 2016 you are good to go. If your Form 4 was post marked July 13, 2016 you will be S.O.L. and have to resubmit per all the new 41P rules.
 
Crap. I'm sure with the way ATF is going now, many of us will be in this boat. 90+ days to process a Form 3 and then start over.

Maybe, maybe not. If you can get your local dealer to submit your Form 4 shortly after the Form 3 is submitted that would put your Form 4 in before July 13th.

Someone please correct me if I'm wrong but I believe it's one of those gray areas and is a practice that will likely be getting a lot of use between now and July 13th.

Hey Steve, maybe you can help clear this up for me, if you choose to answer by PM that's fine too, but the way I understand it there is nothing illegal per say about sending in a Form 4 before you actually have the item in your hands, correct? It's always been explained to me as being a gray area or technicality that provides an opportunity to send in a Form 4 before you actually have the item in your hands and basically once the receiving dealer has been issued the serial # for an item there is nothing that says you can't proceed with sending in a completed Form 4 and the $200 check. Is this your understanding of it, too??

To be a transferor of an item, you must be approved (via form 3) to possess the item and if approved, you should possess the item.

NFA, 26 U.S.C. Chapter 53, Section 479.84 The application, Form 4 (Firearms), shall be filed by the transferor and shall identify the firearm to be transferred by type; serial number; name and address of the manufacturer and importer, if known; model; caliber, gauge or size; in the case of a short-barreled shotgun or a short-barreled rifle, the length of the barrel; in the case of a weapon made from a rifle or shotgun, the overall length of the weapon and the length of the barrel; and any other identifying marks on the firearm.

Silencer Shop has a waiver to transfer, via Form 3, while concurrently transferring via Form 4. No waiver, not legal.

The short answer: No, not legally.

Silencer Shop with a trust or local dealer, those are our choices for a guaranteed 'legal' submission. I have a can that's about two weeks into a F3 to my dealer, it will be a crapshoot whether or not it gets here in time.

I'm not sure how close that dealer is but if I were you I'd be calling every [beeep] SOT within a 3 hr drive if I had to looking for the can(s) I wanted to get the ball rolling on a F4 if SS doesn't have what you want.

Pick up phone, start calling dealers in your State, find a can, buy the can, get S/N of said can (digitial photos if need be to verify), have dealer fill out his portion of the F4 and mail it to you (make sure they check the box to allow you to call the NFA Branch to check on the status, if they refuse a simple FOAD then on to the next dealer imo) and then you submit by July 12th! This way you only have one drive to pick the can up.
 
Slim picking in MO. The guy I'm using is 1 1/2 hours away. Next closest is 3 hours away. He has no stock and want me to order it and says it "might be here by July". Almost is only good enough in a few situations. Guess I'll be one of the first to get screwed over by 41P. I'll be able to tell everyone about my experience. I plan on having the photos of myself and the other trustee ready (since pics only have to be within the last year), then we'll go to the sheriffs office 1 hour away, get fingerprinted and notify him as required, at the same time.

Wow, not sure what part of Missouri you're in but that sucks on your choices. I'm sure you already went to Silencer Shop and put your zip code in to show the locations of Powered By dealers, if you haven't it would be worth a shot.

That attitude from local dealers is what lead to the rise of Silencer Shop and now some other large internet dealers that truly put the customer first.

Not sure how close you are to St. Louis but I plugged in a zip code from that area and found a bunch of dealers via SS that you could call directly to see what they have on the shelf. I don't remember the number within a 100 mile radius but seems like there was quite a few.
