Worse, some jurisdictions that have criminalized the private transfer of firearms have also shut down access to guns stores or their state criminal background check system. This lethal combination of misguided policies has made it impossible for millions of Americans to acquire, or even borrow or lend, firearms during this moment of crisis.

However, the COVID-19 pandemic has made clear that when governments are incapable or unwilling to perform the gun control measures for which they have been tasked, law-abiding citizens end up being denied their Second Amendment rights in total.

The Betray State: Massachusetts's Anti-gun Politicians Use Pandemic to Trample Rights
In recent years, the Bay State's two highest-ranking public officials have been at war with the Second Amendment. In 2016, Attorney General Maura Healey (D) unilaterally perverted a state law that had been on the books for 18 years in order to prohibit thousands of legal semi-automatic firearms. In 2018, Governor Charlie Baker (R) undermined the government's system of checks and balances to attack gun owners when he refused to reinstate some Massachusetts residents' Firearm Owner Identification (FID) Cards after the Firearm Licensing Review Board had restored their gun rights and a judge had issued a lawful court order directing the state to grant the FID card. Baker finally backed off this position in early 2019, but only for those who obtained a court order directing the state to issue them an FID card.

U.S. Senators Use COVID-19 to Push Longtime Gun Control Agenda

The COVID-19 panic has been used by would-be state and local authoritarians as an excuse to keep Americans from exercising their right to keep and bear arms. Thankfully, American gun owners have a friend in the White House that has worked to protect their rights on the federal level by declaring the firearms industry to be critical infrastructure. However, this respect for the Second Amendment isn't uniform in the federal government. There are some federal lawmakers seeking to exploit

Citing COVID-19, California Extends Ex Parte "Red Flag" Gun Confiscation Orders to 110 Days!

A state with one of the worst "Red Flag" gun confiscation laws on the books just got worse. On April 13, California Attorney General Xavier Becerra issued a guidance document on the procedures concerning certain types of restraining orders. Citing the ongoing COVID-19 panic, Becerra noted that all ex parte Gun Violence Restraining Orders (EGVROs) are to be extended 90 days past the statutory expiration date. Under state law, such orders expire after 21 days - meaning that an ex parte GVRO may now last up to 110 days. California's latest attack on gun rights and due process should serve as a warning to gun owners across the country about the dangers inherent to "Red Flag" gun confiscation laws.

Virginia Anti-gun Activist Unveils 2021 Gun Control Agenda

On April 10, disgraced Virginia Governor Ralph Northam signed five pieces of anti-gun legislation into law. Those measures criminalize the private sale of firearms, ration handgun sales to one a month, create a "red flag" gun confiscation scheme, punish property crime victims who fail to hastily report a firearm as stolen, and restrict how Virginia parents may store and introduce their children to firearms. Northam sent two pieces of anti-gun legislation back, including legislation that erodes the Right-to-Carry and the state firearms preemption statute, to the general assembly with governor's amendments. The General Assembly enacted both items of legislation on April 22.

Kim Rhode is one of America’s most decorated Olympians, having medaled in six consecutive summer games. On Friday May 1, the Chief U.S. District Judge for the Northern District of Florida Mark E. Walker denied almost all of the state's motion to dismiss, allowing the case to move forward. Citing the relevant caselaw, Walker noted that NRA's complaint "contains 'enough facts to state a claim to relief that is plausible on its face."

Despite Confiscation, New Zealand Sees Most Gun Crime in a Decade

On April 5, 2019, three days after New Zealand's Arms Amendment Act 2019 advanced from its first reading in parliament, NRA-ILA noted that "[g]iven the abundant research on Australia’s similar gun confiscation efforts, New Zealand officials can expect that their gun control measures will do little more than trample the natural rights of gun owners..." Not Funny: Firearm Prohibitionists Finally Target Elmer Fudd’s Gun

For some in the pro-gun community, the term “Fudd” denotes a person who owns guns, typically not for self-defense, but considers themselves above the fray of Second Amendment politics. But it is not owning this or that type of gun that makes a person a Fudd. Rather, it’s an attitude of indifference to the besieged plight of gun owners generally. Legal Reckoning for Jackson, MS Mayor’s Foolish Carry Ban

As we reported earlier, Chokwe Lumumba, the mayor of Jackson, Mississippi, announced an executive order on April 24 as part of his response to the COVID-19 civil emergency. The order prohibited the “carrying of an unconcealed loaded or unloaded pistol or revolver or any other firearm, carried upon the person or in a sheath, belt holster or shoulder holster or in a purse, handbag, satchel, other similar bag or briefcase or fully enclosed case, with such pistol, revolver, or firearm being wholly or partially visible.”

Florida Court Recognizes Popularity of Carry Permits, Rules Police Cannot Use Possession of a Gun as Sole Basis for Investigatory Stops

An appellate court in Florida recently decided that a police officer who sees a firearm when approaching a citizen is not permitted to rely exclusively on the possession of the firearm as the justification for an investigatory stop and search. Bearing arms is not only a lawful activity, it is “a specifically enumerated right” protected under both the state and federal constitutions. Taking into consideration the sheer number of persons in the state who are permitted to carry concealed weapons, this “potentially lawful activity cannot be the sole basis for a detention. If this were allowed, the Fourth Amendment would be eviscerated.”

Trump Hits Judicial Milestone

This week, President Donald Trump’s 200th judicial nominee was confirmed; Judge Cory Wilson of Mississippi. Wilson will join the U.S. Court of Appeals for the Fifth Circuit. Trump has now filled all federal circuit court vacancies, and appointed more appellate judges than any other president at this point in his presidency. He is closing in on making as many circuit court appointments as President Obama made throughout his two terms in the White House.
