WOLVERINE WILL GET A 12-MONTH FINDING ON ESA LISTING -
The government's 90-day finding and decision not to list
the North American wolverine under the ESA (Endangered Species Act) or begin a
status review was found to be in error. A federal court
found that the listing petition presented substantial
information such that a reasonable person would believe
that listing may be warranted. It ordered the U.S. Fish
and Wildlife Service to conduct a 12-month finding on
whether the wolverine should be listed. The wolverine has
been largely extirpated in its historical range from
trapping, loss of habitat and habitat disruption from
human activities. Defenders of Wildlife v. Kempthorne,
No.CV 05-99-M-DWM (U.S.Dist.Ct., D.Mont., Sept. 29, 2006).

So does this follow the course of action the wolf process does? Are they saying they are consdiering to delist it? I am a bit confused by the article. I know people who say they have seen the Wolverines in CO, but I am dountful.

I guess that once again a judge knows the subject better than the scientists who got biology degrees and who's job it is to figure this stuff out. What a system.

We get sued all the time. Hopefully our research and data will stand up to intense scrutiny. Like Leon said, those that bring lawsuites such as this shop around until they find a "friendly" judge. Here in Montana we can still trap wolverine. /ubbthreads/images/graemlins/grin.gif
