FEDS Order Info on ATN Obsidian 4 App Users for ITAR

According to a court order filed by the Department of Justice (DOJ) on September 5, investigators want information on users of Obsidian 4, a tool used to control rifle scopes made by night-vision specialist American Technologies Network Corp.
 
They're trying to use the app to track how many thermals are traveling over sea's to countries on the terrorist watch list.
 
Its only for the purpose of finding out if bad guys are getting the product. The government would never use that information against law abiding citizens, right?
 

So, do I understand correctly that the only ones vunerable to this nonesense are those who downloaded an app to their iphone to specifically allow streaming? I assume people who just purchased scopes and went hunting with them are not included.

Does this mean that any brand of scope that allows streaming from downloaded apps might be included?
 
Only ITAR restricted Weapon Scopes and scanners, which is basically all GEN III NV devices and all 30 and 60Hz thermal devices, 9Hz thermal devices are exempt.

This particular DOJ investigation is targeted at ATN merchandise. ATN has been the target of numerous investigations like this.
 
They are wanting to see who all has been using the Obsidian 4 app to see if it has been used on devices in places where the scopes should not be used. What I don't understand though, is ATN has a line of products that run under the name of "Mars" which is legally sold in other countries. They are pretty much exactly the same as the optics sold here, they just are sold under another name for ITAR reasons i believe. If the new 4k line that uses the obsidian 4 app is in deed available in other countries like the last line they came out with is, what good is getting all this data gonna do?
 

I am posting this because it happened to me.
I meet a fellow on Facebook and sold him a CZ plastic gun stock.
This is part of the paperwork I got from Homeland.
This law has been on the books for over 100 years.
After I got my stock back two ICE agents came to my home.
They question me how I knew this fellow and given the third degree.
I got to be friends with a Homeland/ICE Agent from Chicago.
I know about his Russian wife and he likes to bake French pastries.
This ordeal took around 6 months to get my stock back.
If you want to ship anything firearm related you must have a permit
from the US State Department. That means screws, scopes, or anything.
The ICE agents were shocked that I had my stock back.
It must have cost US taxpayers $5000 over a $50 plastic stock.
I lost $65 from the Post office, $50 fine and $22 shipping back home.
